Acceptance of Terms

By accessing or using BeMeal ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

Eligibility

You must be at least 13 years of age to use BeMeal. By using the Service, you represent and warrant that you meet this age requirement. If you are under the age of 18, you must have the consent of a parent or legal guardian to use the Service.

Account Responsibilities

You are responsible for maintaining the accuracy of the information you provide when creating your account, including your email address and username. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must notify us immediately at support@bemeal.app if you become aware of any unauthorized use of your account.

Content Ownership & License

You retain ownership of any content (photos, text, and other materials) that you post on BeMeal. By posting content, you grant BeMeal a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and providing the Service. This license ends when you delete your content or your account, except where your content has been shared with others and they have not deleted it.

Prohibited Content

You agree not to post or share any of the following through BeMeal:

Non-food images or content that is not related to meals and food
Harassment, bullying, or threatening behaviour directed at other users
Hate speech, discrimination, or content promoting violence
Illegal content or content that promotes illegal activities
Impersonation of other individuals or entities
Sexually explicit or graphic content
Spam, advertising, or unsolicited commercial content
Content that infringes on the intellectual property rights of others

Content Moderation

BeMeal uses a combination of automated and human review to enforce these Terms:

AI-powered food detection: Photos are analyzed by AWS Rekognition to verify that they contain food-related content. Posts may be rejected if they are not food-related.
User reporting: Users can report content that violates these Terms.
Admin review: Reported content is reviewed by BeMeal staff.

You have the right to request a human review of any automated content moderation decision by contacting support@bemeal.app.

AI Processing Disclosure

BeMeal uses artificial intelligence to enhance the Service:

Food verification: Photos are analyzed by AWS Rekognition to determine whether they contain food-related content.
Content safety: AWS Rekognition is used to detect potentially inappropriate content.
Accessibility descriptions: OpenAI is used to generate alternative text descriptions of food photos to improve accessibility for users with visual impairments.

No automated decisions are made that produce legal effects or similarly significant effects on you. You may request human review of any automated content moderation decision.

DMCA / Copyright

BeMeal respects the intellectual property rights of others. If you believe that your copyrighted work has been used in a way that constitutes copyright infringement, please send a written notification to support@bemeal.app containing:

A description of the copyrighted work you claim has been infringed
A description of where the allegedly infringing material is located on the Service
Your contact information (name, address, telephone number, email)
A statement that you have a good faith belief that the use is not authorized
A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner
Your physical or electronic signature

If your content has been removed due to a DMCA takedown notice and you believe the removal was in error, you may submit a counter-notification to support@bemeal.app containing the information required under applicable law.

Third-Party Services

BeMeal relies on the following third-party services to operate. By using BeMeal, you acknowledge that your data may be processed by these providers in accordance with their respective privacy policies:

Supabase: Authentication and database infrastructure
Amazon Web Services (AWS): Compute, media storage, and AI services (Rekognition)
OpenAI: Accessibility alt text generation for food photos
Sentry: Crash reporting and error tracking
Expo: Over-the-air app updates
Foursquare: Location and restaurant search
Firebase Cloud Messaging (FCM): Push notification delivery

Termination

BeMeal may suspend or terminate your account and access to the Service at any time, with or without notice, if you violate these Terms or engage in behaviour that is harmful to other users, the Service, or third parties. You may delete your account at any time through the app settings. Upon termination, your right to use the Service ceases immediately.

Limitation of Liability

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. BeMeal does not warrant that the Service will be uninterrupted, secure, or error-free. To the fullest extent permitted by applicable law, BeMeal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of the applicable jurisdiction. (Specific governing law and jurisdiction to be confirmed by legal counsel.)

Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by other means (such as email) prior to the changes taking effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the updated Terms.
